  1. General Terms

    PLEASE READ THE ENTIRE TERMS OF USE BEFORE ACCESSING OR USING GOPAY JAGO VIA GOJEK APPLICATION.



    This Terms of Use is an agreement between Users (“You, Your”or “Yourself”) and (i) PT Aplikasi Karya Anak Bangsa, a limited liability company duly established and legally operating under the laws of the Republic of Indonesia and domiciled in DKI Jakarta, Indonesia; (ii) PT Dompet Anak Bangsa, a limited liability company duly established and legally operating under the laws of the Republic of Indonesia and domiciled in DKI Jakarta, Indonesia (PT Aplikasi Karya Anak Bangsa and PT Dompet Anak Bangsa are hereinafter collectively and individually shall be referred to as “We”, “Us” or “Our”). This Terms of Use governs Your access and use of Jago accounts and pockets (“Jago Accounts”) and Jago features and services (“Jago Services”) via the application provided by Us (“Application”).



    By agreeing to this Terms of Use, You also agree to the relevant terms of use, including the Gojek terms of use, GoPay terms of use and terms of use of other services You access in the Application, and changes that are an integral part of this Terms of Use and each of the aforementioned terms of use. 




  2. Accessing and Using Jago Account via the Application 

    The access and use of Jago Account and Jago Services via the Application are subject to this Terms of Use.



    You have full discretion either to access and use the Jago Account and Jago Services via the Application, or not to access and use the Jago Account and Jago Services via the Application.



    We only facilitate You to submit instructions to and access the information and Jago Services provided by the issuer of Your Jago Account. All Jago Services are provided directly and independently by the issuer of Your Jago Account (“Service Provider”).



    When submitting an instruction relating a Jago Service, the Application may pass through Your instruction and related information to the Service Provider.



    Furthermore, if the Service Provider makes available information related to Your instruction and/or Your Jago Account to be shown in the Application, We may inform such information through the Application.




  3. Linking Existing Jago Account

    Subject to this Terms of Use, You may access Your Jago Account via Application by way of linking. Before linking Your Jago Account, You must agree to this Terms of Use and Privacy Policy, and identify Yourself by providing information We need. When linking, We may ask You to provide certain information about You and Your Jago Account, including Your electronic mail address and valid mobile phone number which are registered in Your Jago Account. At any time Your Jago Account is linked in the Application, You warrant that You have separately agreed and shall always maintain such agreement to the Service Provider’s terms and conditions as may be accessed in https://jago.com/en/terms-and-conditions.



    The Service Provider may request certain information about You separately and conduct authentication following Your Jago Account linking request. We are not authenticating Your Jago Account linking request and shall not be liable for any risks related to the authentication of Your Jago Account linking request, including the approval or the rejection of Your Jago Account linking request.



    In the event the Service Provider unlinks Your Jago Account from the Application at any time, We are not responsible for this. In the event that Your Jago Account has been unlinked from the Application, then You need to go through the linking process if You wish to re-link Your Jago Account.



    In the event that authentication is required for linking by way of code verification, including one time password (OTP) verification:



    WE WILL NEVER ASK YOU TO SHARE YOUR VERIFICATION CODE. NEVER PROVIDE THE VERIFICATION CODE TO ANYONE EVEN TO ANYONE, INCLUDING THOSE WHO ACKNOWLEDGE THEMSELVES AS OUR REPRESENTATIVES.



    When You link Your Jago Account to the Application, You agree that we may collect certain information about You from the Service Provider, including but not limited to the information about Your Jago Account e.g. Your Jago Account details (including name and image), Jago Account balance and Jago Account transaction history, and information and document You submitted for Jago Account verification e.g. Your full name, identity card numbers, type of identity card submitted, address, gender, place and date of birth, occupation, tax details, nationality and/or biometric data.



    When Your Jago Account is linked to the Application, We may make available and accessible via the Application the information about Your Jago Account including Your Jago Account details (including name and image), Jago Account balance and Jago Account transaction history. After You link Your Jago Account, temporarily you may not be able to unlink Your Jago main account from the Application. The option to unlink the main account will be provided later. This may result in the continuation of visibility of Jago Account balance in Application. However, You may be provided with an option to unlink Your Jago pocket from the Application. Once a pocket is unlinked, such pocket will not be available for payment for certain services in the Application until You relink the pocket.



    You agree that Your Jago Account linking request constitutes the request for Your GoPay account verification. Upon the approval of Your Jago Account linking request, We may verify Your GoPay account using the information and document You submitted for Jago Account verification. If prior to this Your GoPay account is not verified, You may find the status of Your GoPay account as a verified account. If prior to this Your GoPay account is verified but with different information and document than the information and document You submitted for Jago Account verification, as a protection measure, We may assess this finding and decide to: i) roll back Your GoPay account status to unverified and ask You to resubmit GoPay account verification request; or ii) unlink Your Jago Account from the Application.




  4. Registering for Jago Account

    Subject to this Terms of Use, if made available, You may register for a Jago Account via Application. Before registering for a Jago Account, You must agree to this Terms of Use and Privacy Policy, and pass the GoPay account verification subject to GoPay terms of use. We may disclose the information and document You submitted for GoPay account verification to the Service Provider for the purpose of processing Your Jago Account registration request.



    The Service Provider may request certain information about You separately and conduct verification following Your Jago Account registration request. We are not verifying Your Jago Account registration request and shall not be liable for any risks related to the verification of Your Jago Account registration request, including the approval or the rejection of Your Jago Account registration request.



    In the event the Service Provider rolls back Your Jago Account status to unverified or suspend Your Jago Account, We are not responsible for this.



    You agree that Your Jago Account registration request via the Application constitutes the request for Your Jago Account linking to the Application. Upon the approval of Your Jago Account registration request, We may link Your Jago Account to the Application.




  5. Your Jago Account and Jago Services

    Your Jago Account is issued, provided and managed by the Service Provider. We only facilitate You to access via the Application the information about Your Jago Account as provided to us by the Service Provider. To the extent permissible by law, We are not responsible for the correctness of the information about Your Jago Account provided to us by the Service Provider that We show in the Application. Further, We are not responsible for any risks related to Your Jago Account that is linked to the Application that arises out of Your fault or any third party’s fault. 



    The Jago Services include but not limited to the Jago saving account or pocket service, Jago payment account or pocket service, Jago payment service, Jago fund transfer service are provided by the Service Provider and any other digital banking and its supporting services offered and/or provided by the Service Provider. The Jago Services are provided by the Service Provider. We only facilitate You to submit instructions via the Application to access or order the Services made available by the Service Provider via the Application. To the extent permissible by law, We are not responsible for the processing or non processing of Your instructions by the Service Provider and any related risks related to such processing or non processing of Your instructions by the Service Provider. 



    We reserve the right to unlink Your Jago Account or refuse to submit Your instruction to the Service Provider (including for payment of a service) for certain reasons, including but not limited to any suspicion based on sufficient reason that: i) Your Gojek or Jago Account is compromised; ii) You are in breach of this Terms of Use, other relevant terms of use and any applicable laws and regulations, and/or iii) there is suspicious activity in Your Gojek account, GoPay account and/or Jago Account that is linked to the Application. Further we reserve the right to unlink Your Jago Account if requested by the Service Provider or by authority.



    The security and confidentiality of Your Gojek account is associated with the security and confidentiality of Your Jago Account linked to the Application. The security and confidentiality of Your Gojek account and Your Jago Account, including registered name, electronic mail address, registered mobile number, as well as verification code generated and sent by Our or the Service Provider’s system are fully Your personal responsibility. All losses and risks arising from Your negligence in maintaining such security and confidentiality are borne by You. In such cases, We assume any use or order made through Your Jago Account linked to the Application as Your legitimate request.




  6. Personal Information

    You agree that We may share data, including your personal data, to the Service Provider or other parties for the purpose of providing you access to Jago Account and Jago Services. Collection, storing, processing, use and sharing of Your personal information are also subject to the Privacy Policy, which is an integral part of this Terms of Use.




  7. Content and Offers

    The Service Provider may provide Content which You may find on the Application. In any event where the Content is provided by the Service Provider and We only facilitate the provision of Content provided by the Service Provider, We are not liable to any part of such Content.



    Content means any and/or all information and goods and/or services offering, made and/or compiled and/or developed and/or managed by the Service Provider, including but not limited to text or writing, pictures, quotes or excerption, photos, illustrations, animations, videos, sound or music recordings, titles, descriptions, and/or any other form of data provided by the Service Provider to be displayed on the Application, including any link redirected thereto. For the avoidance of doubt, the Content also includes every and/or all information, data, actual news, writings, images, quotes, photos, illustrations, animations, videos, sound recordings, obtained by the Service Provider from third parties, where the Service Provider has the authority to use and distribute the content. 



    The Service Provider may provide offers or promotions (“Offers”). In any event where Offers are provided by the Service Provider and We only facilitate the provision of Offers provided by the Service Provider, We are not liable to any part of the Offers. 



    You agree to utilize the Offers in accordance with the terms, conditions, and purpose of the Offers and will not abuse, duplicate, monetize, transfer, use for commercial purposes or take unfair advantage of the Offers in any form of manner whatsoever.



    You understand that Offers are not exchangeable for cash, have a limited validity period and are subject to the conditions that apply to each of the Offers.



  8. Your Responsibility

    You are fully responsible for the decisions that You made to access Jago Account and Jago Services via the Application. 



    You are fully responsible for any loss and/or claim arising from the access of Jago Account and use of Jago Services via the Application, either by You or other parties who use Your Gojek account, in a manner that is contrary to this Terms and Use, Privacy Policy, including the terms and conditions and privacy policy set forth by the Service Provider, or applicable laws and regulations, including but not limited to the purposes of anti-money laundering, anti-terrorism financing, criminal activities, fraud in any form (including but not limited to phishing and/or social engineering activities), violations of intellectual property rights, and/or other activities that are harmful to the public and/or any other parties or are considered damaging to Our reputation.




  9. Limitation of Our Responsibility

    We provide the features as is and We do not represent or warrant that the reliability, timeliness, quality, suitability, availability, accuracy, completeness or security of the features will fulfil Your needs and suffice Your expectations, including but not limited to Jago Services which are fully under the Service Provider’s responsibilities. We shall not be responsible for any loss or damage caused by any failure or mistake of the Service Provider or Your failure or mistake in complying to Our and Service Provider’s Terms of Use.



    Features may experience limitations, delays, and other issues contained in the use of internet and electronic communications, including Your or Service Provider’s device is broken, not connected to the internet, out of range, turned off or not functioning. We are not responsible for any delay, failure of delivery, damage or loss arises from such problems.



  10. Miscellaneous

    You fully understand and agree that this Terms of Use constitutes an electronic agreement and Your action of proceeding from the page where the link of this Terms of Use is shown is Your active consent to enter into an agreement with Us that this Terms of Use are legally valid and binding and shall continue so long as You link Your Jago Account to the Application.

I have read and understood all of this Terms of Use and its consequences and hereby accept any rights, obligations, and conditions stipulated therein.
